The federal staffing minimums were rescinded. The staffing data requirement was not. PBJ is still the number the government publishes about you.
Quarterly PBJ submission remains mandatory under 42 CFR § 483.70(q) , and the staffing star on Care Compare is still calculated from those submissions . What changed in February 2026 is the enforceable floor — not the exposure. Every figure below is either your input or a cited federal source.

Rescinded, effective February 2, 2026. The 2024 final rule’s staffing minimums — 3.48 total nurse HPRD, 0.55 RN HPRD, 2.45 nurse-aide HPRD, and 24/7 on-site RN coverage — were vacated in litigation, barred from enforcement by P.L. 119-21 § 71111, and rescinded by CMS. Treat those numbers as reference thresholds, not requirements.
Still in force: the facility assessment. 42 CFR § 483.71 still requires the enhanced facility assessment, still requires it to inform staffing decisions and competencies, and still requires direct-care staff involvement in producing it.
Still in force: PBJ submission. Direct-care hours — employee and agency/contract — must be submitted quarterly from payroll data, 45 days after each fiscal quarter ends.
Still consequential: the staffing star. Case-mix-adjusted total nurse and RN hours per resident day, weekend staffing, and turnover are computed from PBJ and published on Care Compare, where a payor, lender, or surveyor can pull them without asking you.
This is a fragmentation problem before it is a compliance problem. SeniorCRE’s position is that hours-by-role, census, and agency spend belong in one operator-controlled operating record — governed where the data lives, not where it is displayed — so the staffing figure is visible during the quarter rather than after it.
